Cruz Vilaça defends European case law with 'clear and solid' competition law criteria

José Luís da Cruz Vilaça was honoured by Revue Concurrences, in partnership with White & Case and Compass Lexecon, at a debate dinner held on October 31, 2018, in London, at Bentley's Swallow Street Rooms, where dozens of guests who did not want to fail to honour the academic and professional background of the judge of the Court of Justice of the EU.

Mark Powell, of White & Case, when introducing the guest of honour, recalled that the Portuguese lawyer was the first President of the Court of First Instance, created in 1989, presently known as the General Court of the European Union. Powell also highlighted Cruz Vilaça's work as Judge-Rapporteur of the Court of Justice of the EU in the Post Denmark II and Intel cases.

In a speech enthusiastically followed by the guests present, Cruz Vilaça analysed European competition case law on abuse of dominant position and merger control, identifying what he considers to be the challenge for judges.

‘The biggest challenge for judges is to establish clear, solid criteria that can adapt to fast-moving industries, providing legal certainty and predictability in law enforcement’, he said.
