Mariana Martins Pereira, principal associate at CVA, published an article on the latest edition of EU Law Live’s Weekend Edition, under the topic “When the dialogue between courts coexists with far-reaching findings of principle: in search for a pattern, merits and limits”. Using the rulings in Komstroy (C-741/19) and Associação Sindical dos Juízes Portugueses (C-64/16), the author explores the relation between the facts of a case in preliminary references and the development of principled rulings, even in matters not openly addressed by the referring court. In the words of EU Law Live, the text is a ‘timely reminder of the importance of the preliminary reference as a trigger to the development of constitutional principles, but also of its limits’.
